Protection From Abuse (PFA) Orders in Alabama

Helping You Find Safety, Support, and Legal Protection

If you are experiencing threats, harassment, or violence from a spouse, former partner, or family member, you are not alone—and you do have legal options. In Alabama, a Protection From Abuse (PFA) order can provide immediate relief and long-term safety.

At Forrester Law, we take threats of domestic violence seriously. Whether you’re seeking protection or responding to allegations, our family law attorneys are here to help you navigate this process with urgency, discretion, and care.

What Is a Protection From Abuse (PFA) Order?

A Protection From Abuse Order is a legal order issued by an Alabama court that prohibits an abuser from contacting, harassing, threatening, or harming the person seeking protection. PFAs are designed to prevent further abuse and create legal consequences if the order is violated.

You can request a PFA against someone if they:

  • Physically abused you
  • Threatened or attempted to harm you
  • Harassed or stalked you
  • Destroyed property as a form of control or intimidation

The abuser must be someone with whom you share a specific relationship, such as:

  • A current or former spouse
  • Someone you live with or have lived with
  • A family member or relative
  • The parent of your child

How the PFA Process Works

1. Filing the Petition

The process begins when the person seeking protection (the “Petitioner”) files a petition with the local court. This document outlines the abuse or threats and requests that the court issue a protection order.

At Forrester Law, we help you prepare your petition with clarity and precision—ensuring the court understands the urgency and severity of your situation.

2. Emergency Protection (Ex Parte Order)

In urgent situations, the court may issue an emergency (ex parte) PFA without waiting for the other party to respond. This temporary order can:

  • Prohibit the abuser from contacting or coming near you
  • Remove the abuser from a shared residence
  • Award temporary custody of children
  • Provide other immediate safeguards

This emergency order typically lasts until a full court hearing can be held, usually within 10 days.

3. Court Hearing

Both parties will have a chance to appear before a judge at the final PFA hearing. The judge will review evidence, hear testimony, and decide whether to issue a long-term Protection From Abuse Order, which can last up to one year—or longer in certain cases.

We represent both petitioners and respondents in these hearings and prepare thoroughly to protect your rights and safety.

What Can a PFA Order Do?

If granted, a PFA can:

  • Order the abuser to stay away from you, your home, work, school, or children’s daycare
  • Forbid all forms of contact, including texts, calls, and social media
  • Award temporary custody of children and set visitation rules
  • Require the abuser to surrender firearms
  • Order the abuser to pay temporary support or cover certain expenses
  • Provide any other protections the court finds appropriate

Violating a PFA is a criminal offense [link to Domestic Violence page] and can lead to arrest and additional penalties.

If You’ve Been Accused of Abuse

If someone has filed for a PFA against you, the consequences can be immediate and serious—affecting where you live, your access to your children, and even your job.

You have the right to respond, tell your side of the story, and defend yourself in court. We represent individuals who have been served with a PFA petition and work quickly to ensure your rights are protected and your voice is heard.
